ACKNOWLEDGMENT OF LIMITATIONS:
Client acknowledges and agrees that Vitality K9 LLC has not represented, promised, guaranteed, or warranted that Dog can be trained, that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the training will last for any particular amount of time. Client agrees, understands, and acknowledges that the elimination or modification of behaviors is not guaranteed. The Client further acknowledges that dog training will not provide exact results as each dog is different regarding ability, breeding, and temperament. Client understands and agrees that follow-up and future training is their sole responsibility and that they must contact Vitality K9 LLC to schedule future training sessions.
TERMS AND CONDITIONS:
For good and valuable consideration, Vitality K9 LLC agrees to provide the following services: Board and Train. During the program, the dog shall be boarded and trained at the premises of Karlee and Dallon Parks or at any other location deemed appropriate by Karlee and Dallon Parks. Throughout the board and train program, Vitality K9 LLC will provide full-time care, handling, and structured training aimed at creating lasting behavior change. The program includes scheduled appointments for the client to observe and work with their dog throughout the training period. In addition, the client is entitled to one complimentary follow-up private lesson, if needed, to be scheduled within 30 days of the program’s completion. This lesson will focus on reviewing the dog’s progress and providing guidance for continued success at home. The client understands that while the dog will receive professional training, long-term success depends heavily on the owner’s commitment to applying and maintaining the training once the program is complete.
PAYMENT:
Pricing depends on the duration of the training program. The Client is responsible for staying up to date on current pricing, as it is subject to change. The full monthly payment must be paid on or before the start of each four-week training period. For example, the first month is due at drop-off, and subsequent monthly payments are due every four weeks thereafter. No exceptions will be made unless agreed to in writing by Vitality K9 LLC.
A bi-weekly payment plan may be arranged if discussed and agreed upon in advance, but the full monthly payment must be paid before the next four-week mark. If the client fails to make timely payments without communication or valid reasoning—and despite Vitality K9 LLC’s reasonable efforts to resolve the issue—the client will have 14 calendar days from the date of the first missed payment to bring the account current. If no resolution is reached within this period, a late fee of $25 per day will be charged until the account is paid in full. If the account remains unresolved for 60 calendar days from the date of the first missed payment, Vitality K9 LLC reserves the right to rehome the dog in order to recover the costs of care, training, and boarding.
TERMINATION:
Vitality K9 LLC services shall terminate if (a) in Karlee & Dallon Parks judgment, Dog is dangerous or vicious to Karlee & Dallon Parks or any other person or animal or interferes with the training of other dogs without initially being indicated on the application that the dog has aggressive issues, (b) Client breaches any term or condition of this Agreement or (c) Client requests service termination. Upon termination by the preceding, Vitality K9 LLC duties shall terminate, but all other provisions of this Agreement shall continue in full force and effect.
HOLD HARMLESS:
The client will hold Vitality K9 LLC and its associates free and harmless from any and all claims, liability, damage, loss, misuse of products or expenses arising out of any injury to any person or to any person’s property by the dog(s) named in this contract.
RELEASE OF LIABILITY:
Client understands that Vitality K9 LLC is a facility that houses additional animals and, as such, will potentially play, eat, interact, and sleep around other dogs and that there are inherent risks associated with dogs boarding in this environment, including but not limited to injuries due to normal play, rough play, scuffles, fights and attempts to escape and run away despite Karlee & Dallon Parks best efforts to minimize such risks. Client further understands that despite the best care, boarded pets are susceptible to and can develop loose stools, severe diarrhea, hot spots, weight loss, weight gain and excessive shedding. Client agrees to fully release from liability Vitality K9 LLC should their dog become injured, gets fleas, ticks, or worms, becomes pregnant, escapes or runs away, or contracts any malady, illness, or disease during or after all services provided by Vitality K9 LLC, on or off Karlee & Dallon Parks Premises, at Clients Home or Business or any other location including. Client fully accepts these risks and agrees that Vitality K9 LLC shall not be held responsible for it or any resulting injuries, losses, damages, costs, or expenses, including but not limited to veterinarian charges or treatments necessary.
SOLE AGREEMENT:
This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Vitality K9 regarding the matters as described previously. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to the Dog or anything else.
PHOTOGRAPHY AND VIDEO RELEASE:
I understand the Dog may be photographed or video for training purposes only. I agree that these photographs and videos may be posted on social media to show training progress, training ability, and training examples. I agree that Dog’s name may be mentioned in these photographs and videos. Client’s name will not be noted in any video or photograph. Vitality K9 LLC will keep Client’s personal information private at all times.
CLIENT AUTHORIZATION:
I have read, acknowledge and agree to all terms, conditions, and agreements set forth, representing this entire agreement. My initials and signature on the application are proof of my acceptance of this whole agreement. I agree to pay the total price to Vitality K9 LLC and any additional fees discussed. I will be solely responsible for paying any charges incurred for any veterinary care and treatment provided. This agreement has no time limit and is valid and enforceable for any and all future stays for my dog(s) with Vitality K9 LLC unless my information or my dog’s information has changed, in which case it is my sole responsibility to notify Vitality K9 LLC of any changes. Furthermore, I certify that Dog is in good health and has not been ill with any communicable diseases within the past 30 days. I certify that my dog is up to date on vaccines and has not been exposed to Rabies, Distemper, Hepatitis, Leptospirosis, Parainfluenza, Parvovirus, Bordetella (Kennel Cough), Papilloma’s or Conjunctivitis within 30 days before boarding.
Terms, Conditions and Agreements are subject to change anytime. It will be clients’ responsibility to keep current on all Terms, Conditions and Agreements.
